ROLE OF RIGHT TO EDUCATION (RTE) AND ITS IMPLICATIONS

Right to Education (RTE) Act is an Act of the Parliament of India enacted on 4 August 2009, which describes the modalities of the importance of free and compulsory education for children between 6-14 years in India under Article 21A of the Indian Constitution. India became one of 135 countries to make education a fundamental right of every child when the ac­t came into force on April 1, 2010.

Its implications:

  1. Right to Education (RTE) Act, 2009 or Right of children to Free and Compulsory Education.

  2. The Act provides for free and compulsory education to all children of the age of six to fourteen years.

  3. It makes provisions for a non-admitted child to be admitted to an age appropriate class.

  4. The Right of children to Free and Compulsory Education Act came into force on April 1, 2010. This is a historic day for the people of India. From this day, the right to education will be accorded the same legal status as the right to life as provided by Article 21A of the Indian Constitution.

  5. Every child in the age group of 6-14 years will be provided 8 years of elementary education in an age appropriate classroom in the vicinity of his or her neighbourhood.

  6. It has been made a Fundamental Right in the Constitution.

It provides for the development of a curriculum in consonance with the values enshrined in the Constitution, and which would ensure the all-round development of the child, building on the child’s knowledge, potentiality and talent and making the child free of fear, trauma and anxiety through a system of child-friendly and child-centered learning.
